AI for family law practitioners: prenups, postnups and marital settlement agreements in Word

Family law practitioners draft and negotiate some of the most personal contracts there are: premarital agreements, postmarital agreements, marital settlement agreements, parenting plans and property settlements. They are also long, heavily negotiated documents where a single inconsistent definition or a missing disclosure schedule can sink enforceability years later. AI can do the first-pass reading so you spend your time on the client and the strategy.

Plain answer first: LexDraft does not have a family law playbook. Its four built-in playbooks are NDA, SaaS MSA, DPA and Services. For a prenup, postnup or settlement agreement you run a general clause-by-clause review in Word with the governing-law state selected, plus the rule-based defined-term and cross-reference checks. LexDraft does not calculate child support or spousal support and does not prepare court forms.

Where AI helps in a family law practice

  • Reviewing the other side's draft. A general review flags one-sided waivers, vague definitions of separate and marital property, missing sunset or review clauses and gaps in the disclosure provisions, and proposes tracked-change redlines.
  • Consistency checks. Settlement agreements cross-refer constantly: to schedules of assets, to the parenting plan, to retirement division orders. The defined-term and cross-reference checks catch broken references in seconds.
  • Refining your own templates. Run your standard premarital agreement through a review once a year to catch drift and outdated language.
  • Firm contracts. Client portal, e-signature and practice management subscriptions are SaaS agreements, so the SaaS MSA and DPA playbooks apply.

Premarital agreements: the UPAA and state variations

A majority of states and D.C. have adopted the Uniform Premarital Agreement Act (1983), often with changes. Under the uniform text, a premarital agreement must be in writing and signed by both parties, is enforceable without consideration and takes effect on marriage. It is not enforceable if the challenging party shows they did not sign voluntarily, or that it was unconscionable when signed and they did not receive fair disclosure of the other party's property and obligations, did not waive disclosure in writing and could not reasonably have known. It cannot adversely affect a child's right to support.

  • Know your state's version. California, for example, adds a timing rule (the agreement must be presented at least seven calendar days before signing) and requires independent counsel, or a detailed written waiver, for the party against whom it is enforced (Cal. Fam. Code 1615). A spousal support waiver there is unenforceable unless that party had independent counsel or it is not unconscionable at enforcement (Cal. Fam. Code 1612(c)).
  • Disclosure schedules. Attach them, make them reasonably complete and have both parties initial them. Missing disclosure is the most common enforceability argument.
  • Independent counsel and timing. Even where not required, separate counsel and signing well before the wedding make a voluntariness challenge much harder.
  • The newer uniform act. The Uniform Premarital and Marital Agreements Act (2012) covers both premarital and marital agreements and adds stronger disclosure and counsel protections. Only a few states have adopted it, including Colorado and North Dakota.

Postnuptial agreements

Postmarital agreements are enforceable in most states, but the standard is often stricter than for prenups because spouses owe each other fiduciary duties. Some states only recently allowed them: Ohio permitted postnuptial agreements from March 2023. In Louisiana, a matrimonial agreement made during marriage generally needs court approval unless it is made within a year of the spouses moving into the state (La. Civ. Code art. 2329). Check your state's rule before relying on any template.

Marital settlement agreements

  • Retirement accounts. Dividing an ERISA plan needs a qualified domestic relations order (29 U.S.C. 1056(d)(3)). Make sure the agreement describes the division precisely enough for the order to follow it.
  • Alimony tax treatment. For divorce or separation instruments executed after 31 December 2018, alimony is not deductible by the payer or taxable to the recipient for federal income tax purposes.
  • Child support and custody. Courts keep authority over child support and parenting arrangements, whatever the parties agree. Draft those terms as proposals the court can adopt.
  • Merger or incorporation. Whether the agreement merges into the decree or survives as a contract affects enforcement and modification.

A workflow in Word with LexDraft

  1. Open the agreement in Word and open LexDraft in the side panel.
  2. Select the governing-law state and run a general review. Findings are graded Critical, High, Medium or Low, with missing standard terms flagged.
  3. Run the defined-term and cross-reference quick checks.
  4. Accept the word-level redlines you agree with as native Word tracked changes, reject the rest and add your own.
  5. Check the enforceability points above against your state's statute and case law yourself.

What LexDraft does not do
